Getting a new phone
Well, strangely enough, my birthday is coming up, coincidentally the same day as Christmas.
My parents have decided to Christmas/Birthday gift me a new phone to replace my 4 year-old veteran.
Going to law school next year, so email needs to be accessible...as in...constantly accessible.
iphone or blackberry?
I won't be dicking around with apps on an iphone, and I'm kind of wary of scratching it up, but give me an answer guru!

Ahh.. both very good phones. ^^;
If you get bored sometimes and want something fun to do.. the iPhone is great company. ^^;
Blackberry is very good for the business side. If you text a lot or need to use the qwerty keys a lot then blackberry for that.. iPhone can get very annoying when you need to type a lot.. ><
I have had both Blackberry and iPhone.. Both very good phones but for me the iPhone is a much better pick.. just the apps I have on it are very useful!

I have a Blackberry Curve 8330, and I think it's a pretty solid device. The full keyboard is definitely a plus, especially when you're typing long emails or text messages.
In your case, I think you're better off with a Blackberry.
By the way, with Verizon, the email+internet is an extra $30 a month.

Assuming you're on AT&T since you're deciding between a Blackberry and an iPhone, I personally would go with the Blackberry as it would do exactly what you want and would do it better. Blackberry has been doing email and net on their phones for a lot longer.
But if you are not with AT&T or not limiting yourself to that company, I would go with one of the new smartphones that Verizon has. (HTC Imagio, HTC Droid Eris, and Motorola Droid) I have the Imagio myself and couldn't be happier, though if I had waited a few weeks to a month I would have gotten the Motorola Droid.
Much better network/service coming from Verizon IMO.

Do not get iPhone. All my friends have had bad experiences with them. They crash a lot and a lot of times they are unresponsive. Also the internal battery thing still makes me cringe. My opinion is that the iPhone is just trendy...
I personally have a Samsung Omnia and it's working wonders.

iPhones are pretty hard to scratch. The 3GS has a newer kind of screen coating that makes them even tougher as well. I dropped my old one (1st generation) screen down on concrete, then again on gravel, with no damage done to the screen. The new ones are even tougher.
The touchscreen on the iPhone is pretty nice and the keyboard is not problem to use. I'm actually a little quicker with the touchscreen keyboard than I am with a physical one. Most people find that to be the case since you don't have to cram any buttons down. Plus the trackball thingy on Blackberrys bugs me.
I've never had any issues with hardware reliability. I work at a university where half the staff uses Blackberrys and the other half use iPhones. I've probably seen more issues with Blackberrys simply because people seem more prone to abuse them, while iPhone owners tend to be more careful. Other than that, they seem about even has far as hardware reliability goes.
The non-removable battery isn't an issue either really, especially given how often people upgrade their phones. After two years using the original one, I started to notice a slight drop off in the battery life, but nothing that was unmanageable. The technology is only going to get cheaper as well, so price probably isn't a major concern.
That said, AT&T's service is pretty terrible as far as reliability goes. Since you're in a more urban area, I doubt you'll have any issues. The only real drawback of the iPhone is the service.
Don't believe the hype/hate on either brand. Head down to the store and use them for yourself before you finally decide. That'll be the best indicator for you.

Personally? I have an iPhone, and I completely adore it. It is absolutely 100% responsive, and it has, quite literally, an App for everything. And... I hate Apple for the most part... so that says miles.
AT&T is awful, I agree... but I live in the city, so I don't have issue unless I am traveling.
The iPhone just serves a better purpose for University students. Blackberry has an edge in the business world, but it is slight at best. The iPhone just does more non business oriented stuff, and you say you won't use apps... but once you discover that there are free apps that are absolutely amazing, you will be using them all the time. The voice command Google app is flawless!
Also, you can pick up an iPhone 8GB 3G for 99 bucks, which is cheaper than any decent Blackberry. I'd go for the iPhone all the way. I hated my Blackberry Bold so much..... tiny keyboard = FAIL

I prefer the iphone. Simply because once jailbroken, the options are limitless. Atm my iphone is jailbroken to allow my laptop to do internet tethering. Very handy because my uni's wireless is very unreliable.
Im not sure what kind of plan you have, but from what I've read ATT is not yet setup to charge owners of iphones for tethering. So its win, win for me; well at least for a while anyways.

Get a Sony Satio, so you can be a bit different. It will have all the apps you need. It has the best camera EVAR and if you're chasing ambulances you could use it to take pictures of evidence.
If I could fford it, I'd get a Vertu. IT COMES WITH A FRIKKEN CONCIERGE SERVICE!!
